USING YOUR WILL TO PROTECT YOUR HOME AGAINST NURSING HOME FEES
THE PROBLEM: Generally people leave their estates to each other and then to their children. The trouble is if either of you pass away and the survivor should go into care the house may be sold to pay for their care fees. Leaving your children or next of kin with little or no inheritance. Each year literally thousands of people, needlessly loose their homes to pay for their care fees. THE SOLUTION; You can make or change your Wills to include a clause which leaves your share in your property direct to your children (other beneficiaries) and leave your surviving spouse lifetime residence. This
means, if your spouse were to go into care after your death, you will have
protected half your house against care charges as social services will only be
able to take the remaining half into account. You will also have an allowance
of £21,000 which they can not touch. This also protects your share of the
property for your children (other beneficiaries) were to remarry after you
death. Unfortunately,
the only time you can do this is before it happens, so the sooner done the
better. WHAT
TO DO NEXT;
Your house is probably owned in “Joint Names” so we will need to make
changes in the way you own your property with the Land Registry.
You can then leave your share of your property direct to your
children. We
will also write new Wills for you both which includes a clause leaving your half
of your property direct to your children with a residential rights clause
included in both Wills to allow the survivor to live in the property for as long
as they wish. It will also give
them permission to sell the property and purchase another and invest any surplus
capital for their benefit. HOW
